Montanants to Enjoy Recreational Marijuana from 1st January
Starting on January 1, 2022, the citizens of the Big Sky Country will be able to purchase recreational marijuana legally.
Due to the Initiative, which was passed in November 2020, people who live in the so-called “green counties,” i.e., where most residents voted in favor of legalization, will be allowed to buy recreational marijuana.
On the other hand, people who reside in the so-called “red counties,” i.e., where the majority voted against the legalization, won’t be able to buy recreational marijuana until they take a re-vote.
So, what kind of products will be available? All kinds, starting from marijuana flower, edibles, and tinctures, to topicals, concentrates, and vaporizer cartridges. However, there will be some restrictions, namely:
- All products must be produced in Montana
- Marijuana flower must contain less than 35% THC
- Edibles must not have more than 100mg of THC
Also, note that this applies to recreational sales only, not medical.
With that in mind, marijuana still remains illegal on the federal level. In other words, you won’t be allowed to smoke it in public places and national parks. Driving under the influence will also stay illegal.
Furthermore, for the first 18 months, only medical marijuana businesses who purchased licenses on (or before) November 3, 2020, will be allowed to sell recreational marijuana. All other businesses will be able to apply for a license after July 1, 2023.
Regarding the possession laws, Montanans over 21 will be allowed to buy up to one ounce of marijuana, 8g of concentrate, or 800mg of edibles. They will also be able to grow 2 mature plants and 2 seedlings at home.
